Croatian Copyright Agency performs technical and executive support services to the Croatian Collecting Society for Fine Art „Ars Croatica“.
The Croatian Collecting Society for Fine Art „Ars Croatica“ is a specialized collecting society for the protection of copyrights (especially the resale right) of fine artists, their descendants and other rights holders, realization of their mutual professional interests with a special emphasis on the qualification of an artwork purchase as approved tax expenditure as well as similar issues of general interest for the role of fine arts in the Republic of Croatia.
The resale right is the author's right to an equitable share of the selling price each time his/her original fine art work (painting, drawing, sculpture etc.) is resold after its first alienation by the author.
The resale right applies to all acts of resale involving sellers, buyers or intermediaries, as well as art market professionals, such as public auctions, art galleries or other art dealers.
The resale right grants the author the possibility to control the resale of his art work and to participate in the share of the selling price in each and every purchase.
The author as such cannot realize this resale right since he/she can neither control the trade of the artwork nor oversee its circulation.
In the name and on behalf of the author, the resale right is realized by a collecting society of fine artists.
The Collecting Society, based on the approval of the State Intellectual Property Institute and pursuant to the provisions of the Copyright and Related Rights Act, collectively realizes and protects the resale right of fine artists and their heirs, who have, in a written form, authorized a Collecting Society to act on their behalf.
