Croatian Copyright Agency – Intellectual Property Center d.o.o., provides the service of deposition of copyright works for the purpose of ensuring another material evidence of authorship.
Since copyright in a work, according to the Copyright and Related Rights Act, is granted to its author by the mere act of the creation of the work, and since the law does not stipulate the obligation of storage as a way of obtaining the copyright, the act of deposition as such depends on the author's decision if he/she wants to ensure another material evidence of his/her authorship or not.
Every author can bring one example of his/her work, signed by hand. The author, by his/her signature warrants that all rights have been accrued in a legal way and that there is nothing regarding his work that might infringe on the third parties' rights.
The copyright work that is being deposited should be presented in a written or digital form, and for the works of fine or applied art, photos of original works can be deposited as well. Once the work is deposited, we issue a deposit receipt, which does not affect the existence and duration of copyright as determined by law.
One copy of this receipt is issued to the author of the right holder, while the other is kept for agency's records.

The Croatian Copyright Agency also provides a deposition service of various other intellectual creations, also for the purpose of ensuring another material evidence of authorship.
This refers to various concepts, ideas, know-how, business secrets and projects that perhaps would not be classified as copyright works according to their legal definition, but form an important element in the business activities of every company, especially if we are dealing with a project still in its initiation phase.
The act of deposition is particularly useful in a situation when your intellectual creation (idea, concept, project in its initiation phase, etc.), becomes the subject of business negotiations. Depositing your work you ensure the evidence of your authorship, which makes it easier to prove it in the case of a possible future authorship dispute or in the case of intellectual property theft.
Other intellectual creation can also be deposited as subjects of other intellectual property rights (inventions, trademarks, industrial design, geographical indications) especially in the case when their registration procedure before the State Intellectual Property Institute has not been finalized or has not started yet. |
